The problem with this is that it severely reduces the
effectiveness of the spell in a modern setting, where
most first floors have a gap between it and the earth.
I personally would rule that as long as there was a
solid connection between the character and the ground.
So a character in water or trhe air is unaffected,
while one on the roof of a building or on a dock would
be.
